Abstract
U radu se analizira uloga i značaj osiguranja kako sa aspekta zaštite pojedinca, tako i sa aspekta trgovačkog društva, od potencijalnih rizika. Osiguranje pruža financijsku zaštitu od nepredvidivih događaja. Postoje različite vrste osiguranja, a najčešća su imovinska, auto odgovornosti i zdravstvena osiguranja. Kroz osiguranje je moguće utjecati na neke rizike. Postoje više vrsta rizika. Osnovne vrste rizika u osiguranju su čisti i špekulativni. Čisti rizici uključuju samo šanse za... More gubitak, bez mogućnosti za dobit, dok kod špekulativnih rizika postoji mogućnost dobitka. Osim čištih i špekulativnih postoje još statički, dinamički, financijski, nefinancijski, osnovni i posebni rizici. Zbog toga se osiguranje prvenstveno koristi kao protuteža za rizik. Ugovorom o osiguranju zaključuje se u pisanom obliku između dvije ugovorne strane odnosno između osiguranika i osiguravajućeg društva. Nositelj ugovora obvezan je platiti premiju, a osiguravajuće društvo se obvezuje da će pokriti sve troškove koje proizlaze iz sklopljenog ugovora. Ugovor o osiguranju mora sadržavati: datum početka i završetka osiguranja, ugovaratelja osiguranja, osiguranika, iznos premije, osigurane rizike, doplatke ili popuste, posebne napomene, klauzule o sankcijama, izjave ugovaratelja osiguranja i potpis ugovorenih strana. Elementi police koje ugovor mora sadržavati propisani su Zakonom o obveznim odnosima Hrvatske gospodarske komore. Abstract (english)
The paper analyzes the role and importance of insurance both from the point of view of individual protection and from the aspect of the company of potential risks. Insurance provides financial protection against unpredictable events. There are different types of insurance, and the most common types of insurance that are property, autoliability and health insurance. Through insurance, it is possible to influence some risks. There are several types of risks. The basic types of... More insurance risk are clean an speculative. Pure risks include only chance of loss, no profit opportunities, while speculative risks have the potential to make a profit. In addition to clean and speculative, there are still static, dynamic, financial, non-financial risks, basic and special. For this reason, insurance is primarily used at risk counterparty. Insurance contract is concluded in writing between the two contracting parties, between the insured and the insurance company. The contractor is obliged to pay premium, and the insurance company is obliged to cover all costs arising from the contract. The insurance contract must include: the date of commencement and termination of insurance, allowances or discounts, special remarks, sanction clauses, insurance contractors statement and signature of the both contracting parties. The elements of the police that the contract must contain are prescribed by the Croatian Chamber of commerce Obligations Act. Less
