Abstract
Da bi se izvršila bolja organizacija tržišta te osigurala stabilna konkurentnost svih njezinih sudionika, potrebno je regulativnim mjerama osigurati isto u svim tržišnim segmentima, Kada se u tom smislu radi o regulaciji tržišta na kojem posluju i fizičke i pravne osobe formirajući tržišnu ponudu i potražnju, tada je neophodno putem zakona i mjera javnih politika definirati statusna pitanja svih poslovnih subjekata i fizičkih osoba kao sudionika, utvrditi vrste poslova koji se obavljaju, utemeljiti zakonski okvir po kojem će se obavljati sektorske djelatnosti, definirati kaznene odgovornosti i sankcije za iste ukoliko dođe do tržišnih malverzacija te odrediti fiskalne, ekonomske, društvene i druge obveze. U toj ulozi se javlja država kao vrhovni zakonodavni, izvršni i nadzorni organ cjelokupnog područja na kojem tržište djeluje. Država, dakle svojim mjerama javnih politika, kao i svojom ekonomskom intervencijom te politikom protekcionizma vrši regulaciju i sa svojom nevidljivom rukom istiskuje i obuzdava moć tržišta putem upravljačkih struktura javnih određenih institucija.
Abstract (english)
In order to ensure better organization of the market and to ensure the stable competitiveness of all its participants, it is necessary to ensure the same by regulatory measures in all market segments. it is necessary to define, through laws and public policy measures, the status issues of all businesses and individuals as participants, to determine the types of business to be performed, to establish the legal framework by which to perform sectoral activities, to define criminal liability and sanction for them if market malpractices occur and determine fiscal, economic, social and other commitments. In this role, the state emerges as the supreme legislative, executive and supervisory body of the entire area in which the market operates. The state, therefore, through its public policy measures, as well as through its economic intervention and protectionism policy, regulates and with its invisible hand, suppresses and restrains the power of the market through the governing structures of public designated institutions.
